The Will of Matthew Perratt of North Curry

This is the last Will and Testament of Matthew Perratt of North Curry in the County of Somerset Gentleman made the twenty second day of December one thousand eight hundred and three First I give and devise all my messuages lands hereditaments and premises with the respective rights encumbers and appurtainants thereto belonging situate lying and being in the several parishes of North Curry aforesaid and Stoke Saint Gregory in the said County (which I latterly purchased of Mr Josiah Bridge) unto my son John Dunford Perratt to hold to him my my said son John his heirs and assigns forever And I do hereby subject and charge my said before mentioned Estate and Estates with the payment of all such principal mortgage money and the interest thereof as shall appear to be due thereon at the time of my decease Also I give and devise unto my good friends Thomas Mullins of Goathurst in the said County Gentleman and John Bathepeny of Athelney Farm in the parish of Lyng in the County aforesaid yeoman and the survivor of them his Executors and Administrators for and during all my Estate and Interest therein All that my messuage and Tenement called Atyot's with the Closes of Ground and premises belonging thereto in the said County now in the Occupation of William Burnell In trust to permit and suffer my daughter Ellen to enter and to take the rents fines and profits thereof during her natural life free from any debts engagements power and control of her present or any any future husband she may marry and her receipt shall be sufficient discharge at all times for the rents and profits thereof And from and after her decease I give and bequeath the same unto and equally between all and every the Child and Children (if any) of her my said daughter Ellen lawfully begotten share and share alike for all my Estate and Interest therein And in default of issue of my said daughter Ellen I give and bequeath the same unto my said son John Dunford Perratt his Executors and Administrators for and during all my Estate and Interest therein And I do hereby subject and charge my said last mentioned Estate with the payment of all just principal mortgage money and the interest thereon as shall appear to be due thereon at the time of my decease. Also I give and bequeath to my daughter Mary all those my other Estates called Parkers and Sheppards later Mrs. Millins with the Closes of Grounds and Premises belonging thereto with their Appurtainants in Othery aforesaid to hold to her my said daughter Mary her Executors Administrators and Assigns for and during all my Estate and Interest therein And I do hereby subject and charge my said last mentioned Estate with the payment of all just principal mortgage money and Interest thereof as shall appear to be due at the time of my decease Also I give to my grandson Matthew Perratt my silver watch All the rest and residue of my household goods and furniture (except all my Outdoor Stock and Goods) I give and bequeath to my said son John and the said Mary and Ellen my Daughters to be equally divided between themselves and share alike and for that purpose I do hereby order and direct that the joint shall be equally divided between them by any two respectable men by them indifferently chosen for that purpose and if either of them my said children shall refuse to abide by their Division that then and in such case his her and their part and share of such Goods and furniture so refusing shall go to and be the sole property of him her or them abiding by such division All my Outdoor Stock and Goods Implements of husbandry and all the rest and residue of my goods chattels personal Estate Lands hereditaments and premises not herein before by me given and disposed of I give devise and bequeath unto my said son John Dunford Perratt his Executors Administrators and Assigns And I do hereby make ordain constitute and appoint my said son John whole and sole Executor and Residuary Legatee of this my last Will and Testament desiring him to pay all my just debts and funeral Expenses and to bury me in a decent manner And further I do hereby direct that in case any dispute may arise between my said three children touching anything contained in this my Will or of any of my effects that the same may be finally determined between them by my said Trustees the said Thomas Mullins and John Bathepeny In witness whereof I the said Matthew Perratt the Testator have to this my last Will and Testament contained in two sheets of paper set my hand to the first sheet and my hand and seal to this second and last sheet the day and year first before written Matthew Peratt Signed sealed and published and declared by the Testator Matthew Parratt as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as Witnesses hereto Thos Mullins Jr. of Goathurst Somerset Peter House of North Curry Shopkeeper Henry Foster of North Curry Butcher This Will was proved at London on the twentieth day of October in the year of our Lord One thousand eight hundred and six before the Right Honourable Sir William Urqurt Streight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of John Dunford Perratt the son of the deceased and the sole Executor named in the said Will to whom Administration was granted of all and singular the Goods Chattels and Credits of the said deceased he having been first sworn by Commission duly to administer
