Declaration by Henry Bradley 1765

To all to whom these Presents shall come Henry Bradley of New Alresford in the County of Southampton Gentleman sendeth Greetings Whereas by Indentures of Lease and Release the Lease bearing Date the Day before and the Release bearing even Date with these presents and being of Three parts and made or mentioned to be made between William Thomas of the Parish of Saint Michael near the City of Winchester in the County of Southampton Apothecary Son and Heir of William Thomas of the same parish Gentleman deceased and Benjamin Neville of the Parish of Saint Swithin near the said City of Winchester Butcher of the First part James Dicker of Overton in the County aforesaid Gentleman of the Second part and the said Henry Bradley of the Third part reciting amongst other Things an Indenture of Lease of Willersey Warren High Overton in the said County of Southampton from the Lord Bishop of Winchester to William Dicker Esquire deceased and a Conveyance or Assignment thereof to the said William Thomas deceased and also reciting Several renewed Leases of the said Warren to the said James Dicker and and Several Conveyances and Assignments of such renewed Leases to the said William Thomas deceased for Servicing the Payment of the Sum of Two Thousand Pounds and Interest as therein mentioned And further reciting that there was then due and owing to the said William Thomas the Son and Benjamin Neville as Executors of the last Will and Testament of Elizabeth Thomas deceased who was the Executrix of the Will of the said William Thomas deceased on the said recited Security the said Principal Sum of Two Thousand pounds only All Interest for the same being paid to the Day of the Date thereof And that the said William Thomas and Benjamin Neville the Executors having Occasion for the said Sum of Two Thousand pounds the said Henry Bradley at the Request of the said James Dicker had agreed to advance and lend the same on the Security of the said Premises It is by the said Indenture of Release Witnessed that that in Consideration of the Sum of Two Thousand pounds to the said William Thomas and Benjamin Neville in hand paid by the said Henry Bradley at the request of the said James Dicker testified as therein mentioned And also of Five Shillings to the said James Dicker in Hand likewise paid by the said Henry Bradley they the said William Thomas and Benjamin Neville and each of them by the Direction and Appointment of the said James Dicker testified as aforesaid Did Bargain Sell Assign Release and Set over and the said James Dicker Did grant bargain Sell Assign Release Ratifie and Confirm unto the said Henry Bradley All that the said Land commonly called Willersey Warren and all Libertys Profits and Commoditys thereunto belonging or appertaining and all and singular other the Premises in and by the Several therein recited Indentures of Lease and Release Conveyed and Assigned to the said William Thomas deceased and in and by the last renewed therein recited Indenture of Lease granted with their and every of their Appurtenances To hold unto the said Henry Bradley his Heirs and Assigns for and during the Natural Lives of the said James Dicker William Dicker Son of the said James Dicker deceased and James Dicker Budd Nephew of the said James Dicker and the Life of the longest Liver of them Subject to a proviso for a reconveyance of the said premises on payment by the said James Dicker his Executors Administrators or Assigns unto the said Henry Bradley his Executors Administrators or Assigns of the full Sum of Two Thousand Pounds of lawful Money of Great Britain with Interest for the same after the Rate of Four pounds for One hundred for One year on the Twenty Fourth Day of December next ensuing the Date thereof as in and by the said recited Indentures of Lease and Release relation being to them respectively had doth more fully appear Now Witness these Presents and the said Henry Bradley doth hereby Acknowledge Signify and Declare that the said Sum of Two Thousand Pounds mentioned to be the Consideration Money of the said recited Indenture of Release and to be paid by him to the said William Thomas and Benjamin Neville as aforesaid was not the proper Money of him the said Henry Bradley nor was the same or any part thereof paid by him to the said William Thomas and Benjamin Neville But that it was the proper Money of the said Benjamin Neville And was really and truly paid and advanced by him on the said recited Security And that the said Lands called Willersey Warren and all the Libertys Profits and Commoditys thereunto belonging were assigned and conveyed to him the said Henry Bradley and that his Name was made use of in the said recited Indenture of Lease and Release In Trust only for the said Benjamin Neville his Executors Administrators and Assigns and to and for his and their own proper Use and Benefit And the said Henry Bradley for himself his Heirs Executors and Administrators Doth Covenant promise and Agree to and with the said Benjamin Neville his Executors Administrators and Assigns by these presents That He the said Henry Bradley his Heirs Executors and Administrators shall and will at any time hereafter at the request Costs and Charges of the said Benjamin Neville his Executors Administrators or Assigns in Case the said Sum of Two Thousand pounds or any part thereof or any Interest for the same shall be due and owing at the same shall be due and owing at the time of such request made Convey Assign and transfer the said Land called Willersey Warren and all Libertys Commodities and profits thereunto belonging with the Appurtenances And all the Estate Term and Interest of him the said Henry Bradley his Executors and Administrators therein And also the Indenture of Lease by which the same are held unto and to the use of the said Benjamin Neville his Heirs Executors Administrators and Assigns or unto such other person or persons as he or they shall direct nominate and appoint Subject to such Redemption as aforesaid And in the meantime and Until such Conveyance Assignment or Appointment shall be made shall and will permit and suffer him to receive and take the Interest and Produce of the said Sum of Two Thousand Pounds to his and their own use and and Profit without any Claim or Interruption whatsoever In Witness whereof the said Henry Bradley hath hereto Set his hand and Seal the Twenty ffourth Day of June in the year of our Lord One Thousand Seven Hundred and Sixty Five.
